Understanding Maryland DUI Requirements

Basic DUI Requirements

We know that navigating a DUI can be overwhelming. Understanding the requirements and process after an alcohol related driving offense in Maryland is an important step to getting back on the road. We’ve put together some general information to help you get started. 

According to the Maryland Motor Vehicle Administration (MVA), anyone who operates a vehicle with a blood alcohol content (BAC) of 0.08 or higher is guilty of driving under the influence (DUI). Maryland also recognizes a lesser (but still serious) charge called driving while impaired (DWI), which applies when a driver has a lower BAC but still demonstrates evidence of impairment.

Under the Administrative Per Se law, a police officer will usually confiscate your driver’s license if you fail or refuse to submit to a chemical sobriety test. According to the MVA, the state will typically suspend your license for at least 180 days, depending on factors including whether you have previous DUI convictions and your tested BAC. This administrative suspension happens independently of any penalties a criminal court may impose.

Criminal penalties for a first-offense DUI can include:

  • A fine up to $1,000
  • Up to a year in jail
  • 12 points on your driving record
  • License revocation for six months

For a first-offense DWI (BAC below .08), penalties may include:

  • A fine up to $500
  • Up to two months in jail
  • Eight points on your driving record
  • License revocation for six months

Penalties increase significantly if it’s not your first DUI, or if other aggravating circumstances are present, such as driving with a minor in the vehicle.

License Reinstatement

If you’ve had your license suspended for a DUI or DWI in Maryland, you may be eligible to retain your driving privileges during your administrative suspension period by participating in the Ignition Interlock Device program. You can find information about how to opt into the program on the reverse side of the Order of Suspension that you received when your license was suspended, or you can look it up on the MVA website.

If you’ve been convicted of DUI or DWI in court, you also might be required to install an IID in your vehicle based on the conditions of your sentence. Under HB 105, a law passed by the Maryland legislature in 2024, you will be required to install an IID if any of the following apply to you:

  • ​Probation Before Judgment or Conviction of Driving Under the Influence (DUI);
  • Probation Before Judgment or Conviction of Driving While Impaired (DWI);
  • Driving while intoxicated with an initial breathalyzer test refusal; and
  • Homicide or life-threatening injury by motor vehicle while DUI or DWI.

In practice, this means that most drivers who get a DUI or DWI in Maryland will be required to install an IID.

The required length of the IID program can vary, so you’ll need to find out the specific requirements from your monitoring authority. In general, it’s a good idea to talk to your attorney or monitoring authority about the conditions of your IID program before you opt in, since you may waive some rights by participating, such as the right to contest your suspension in an administrative hearing.

When you’ve completed your program requirements, you can apply to the MVA for reinstatement of your full license, using the steps specified on the MVA website. The MVA will rule on your application and send you a letter if your license can be reinstated. You’ll need to take the letter to a full-service MVA branch and apply for a new license, which may include taking standard driver’s license tests, and usually requires paying a fee of $150 according to the MVA.

What if I have a requirement, but I don’t own a vehicle?

If you have an Ignition Interlock requirement in Maryland, but you don’t own a vehicle, you will have a six month license suspension, and you will not be able to drive a vehicle without an Ignition Interlock Device (IID). 

How do the consequences differ for a first and second DUI? Third? Fourth?

The consequences for each DUI/DWI offense will vary for each individual. Please use the information listed below as a general reference guide. For additional information regarding fees and suspension periods, contact the Maryland Motor Vehicle Administration (MVA) for your specific situation. 
  • First DUI: You will be charged a $1,000 fine. You may also spend up to one year in jail, receive 12 points on your license, and have your license revoked for up to six months. 
  • Second DUI: You will be charged a $2,000 fine. You may also receive up to two years’ imprisonment with mandatory minimum of five days along with 12 points added to your license. For two convictions in five years, there’s a mandatory period of suspension, a minimum requirement period of participation in the ignition interlock program, and your license is revoked for up to one year with mandatory participation in an alcohol abuse assessment program. 
  • Third DUI: You may receive up to three years’ imprisonment. You will be charged a fine of up to $3,000. Your driver’s license may be revoked and you will have 12 points added to your license. 
  • First DWI: You will be charged a $500 fine. You may spend up to two months’ imprisonment, have eight points added to your license, and serve up to a 60-day license suspension. 
  • Second DWI: You will be charged a $500 fine. You may spend up to one year imprisonment, have eight points added to your license, and serve up to a 120-day license suspension. 
  • Offenders under the age of 21 can lose their license, even with a blood alcohol concentration (BAC) level of .02. If the BAC is .08 or greater, the offender will be subject to not only the driver’s license suspension and restriction, but also criminal penalties. 
  • Offenders under the age of 18 will have their case handled in a juvenile court. 

Where does installation fall based on my condition?

In the state of Maryland, you will have 15 days to install an Ignition Interlock Device (IID) after you’ve received the approval letter from the Motor Vehicle Administration (MVA) confirming your eligibility.  

How often does my IID need to be serviced?

Maryland law states that your Ignition Interlock Device (IID) needs to be serviced every 30 days.

Maryland law states that you can service your Ignition Interlock Device (IID) at any Smart Start service center nationwide. 

Where do I send a record of my service appointments?

What happens if I violate?

You are required to report to the Ignition Interlock service center every 30 days. Each time you report one or more violations in a monitoring period, you will receive an auto-generated Violation Notice from the Motor Vehicle Administration (MVA) noting the date and time of the violation(s). Your Ignition Interlock Device (IID) compliance term will be extended by 30 days. If there is a fourth monitoring period containing a violation, you will receive a FINAL NOTICE instructing you to turn in your restricted license, as you will no longer be able to participate in the program. However, after 30 days, you can request reinstatement into the program. 

What constitutes a violation in my state?

In the state of Maryland, the following constitute a violation of the program: 
  • Missing a test. 
  • Tampering with the device. 
  • Failing to report every 30 days. 
  • Low Starts. Less than 50 starts within the 30-day monitoring period. If you cannot meet this requirement (vacation, extensive vehicle repairs, etc.) you should contact your Motor Vehicle Administration (MVA) case manager. 

How do I know if I need a camera/GPS/etc.?

In Maryland, a camera is required. The judge will let you know if you need additional features like GPS. If you are a Maryland resident with an out-of-state conviction (reporting to VA, for example), you may be required to have a camera and a GPS. You should check with that state’s authority to confirm your compliance requirements. 

What if my vehicle needs to be serviced or repaired?

To avoid Failure To Appear violations, you should contact your Motor Vehicle Administration (MVA) case manager if your vehicle will be out of service for an extended period. You will likely have to make up this time. Keep copies of your service records for any time the vehicle is not in your possession. Your case manager will request these to waive any violations registered during this period. 

What if I have a respiratory disorder and cannot take the tests?

You should contact your Motor Vehicle Administration (MVA) case manager. The MVA will require that you have a pulmonary function test performed by your physician and submit the results. If approved the MVA will authorize Smart Start to adjust your device accordingly so you can provide breath tests. Please allow at least 72 hours after your MVA submittal for this process. We will make every accommodation we can to assist you in meeting your compliance requirements. 

What do I need to bring to my installation appointment?

Once you have scheduled an Ignition Interlock Device (IID) installation appointment with Smart Start, you will need to bring the following to your appointment: 
  • You must provide your driver’s license or your valid license number and date of birth. These are required to ensure your records are updated accurately into the Motor Vehicle Administration (MVA) system. 
  • Your vehicle registration indicating a valid tag and title (8 digits) is required to be accepted into the program. An expired tag will not be accepted. 
  • Your letter from the Maryland Motor Vehicle Administration (MVA) may be helpful to have on hand so you can discuss any concerns with our installation technician but it is not required. 
  • Proof of insurance is REQUIRED. You cannot get a valid vehicle registration without proof of insurance. 

What should I bring back to my state authority after my device is installed?

Smart Start will provide you with proof of your installation (MVA Form AJ-13) sealed by our certified technician. You then take this to a Motor Vehicle Administration (MVA) service center to get your IID-restricted driver’s license. 

How do I know who my state authority is?

In Maryland, your state authority or case manager will be indicated on the letter sent to you by the Maryland Motor Vehicle Administration (MVA)Your state authority may also be a probation officer or anyone else assigned by your judge. 

What do I need for removal?
