Basic OWI Requirements
Iowa law defines an OWI as operating a motor vehicle while you have a blood alcohol level of .08 or greater, or while under the influence of alcohol or controlled substances. Getting an OWI in Iowa can make you subject to both civil and criminal penalties.
A first offense is considered a serious misdemeanor and can come with any or all of the following penalties, potentially among others:
- A jail sentence between 48 hours and one year, which can be suspended if the driver meets certain conditions (including having a BAC below .15)
- A fine of up to $1,250, part of which may be waived if the driver performs community service and/or applies for a Temporary Restricted License
- Revocation of the driver’s license for 180 days to a year, and required installment of an Ignition Interlock Device
- Participation in alcohol and drug abuse treatment classes
A second offense is considered an aggravated misdemeanor, and a third is a Class D felony. Penalties increase with every subsequent OWI.
In addition, the Iowa Department of Transportation notes that your driver’s license will be revoked after an OWI offense, even if you aren’t convicted in court. The suspension period can range from 180 days to one year for a first-time OWI, depending on the circumstances of your case. However, as we’ll explain in the next section, you may be able to restore your driving privileges by applying for a Temporary Restricted License (TRL).
License Reinstatement
Iowa drivers who get an OWI may be able to apply for a TRL, which allows them to maintain some driving privileges after getting an OWI. According to the Iowa DOT, you may be eligible for a TRL if:
- You’re over 18
- You have an Ignition Interlock Device installed on all vehicles you drive
- Your OWI did not cause a death
The Iowa DOT also outlines the procedure drivers must follow in order to get a TRL, including:
- Installing an Ignition Interlock Device on all vehicles driven
- Complete Form 430400
- Pay any required civil penalties
- Obtain an SR-22 insurance certificate proving you have the required insurance
- Passing any required exams
- Paying reinstatement and license fees
The terms of your program will dictate when and for what purposes you are allowed to drive, and how long you have to keep your Interlock Device installed for. Check with your monitoring authority to learn about your individual requirements in detail.
When your revocation has ended, you’ll usually need to take all of the following steps to have your license or driving privileges reinstated:
- Pay a $200 civil penalty
- Complete an approved OWI class
- Complete an approved substance abuse evaluation
- Present proof of SR-22 insurance
- Present proof of IID installation
- Make an appointment at the DMV
- Pass any required exams
- Pay reinstatement and license fees
